Maxisil, Inc., (Maxisil), is an Australian-owned supplier for professional construction products, incorporated in Texas, USA, with its headquarters in Carrum Downs, Victoria, Australia. For over 20 years, Maxisil’s Products have been the go-to, trusted brand for premium silicone, tools, and tiling accessories in Australia. With our new, direct-to-consumer website, https://maxisil.com (Site), Maxisil is bringing our premium products (Products) to the United States (our Services). Maxisil aspires to build the same high-level of trust with our US customers, not only with our Products, but also as it concerns our use of their personal information and the protection of their privacy. As part of that effort, in this Notice we explain how Maxisil collects, uses and shares the personal information we hold about you, our customers.

In this Notice, any references to “Maxisil”, “we”, “our” or “us” or even the “Company” is a reference to Maxisil incorporated in Texas, USA, and based in Victoria, Australia.

This Notice applies to Maxisil where we determine what, why and how we use the personal information we collect for sales of our Products, customer service, marketing or other legitimate business purposes, and how in that capacity we act as the “Controller” of the information we collect. To be clear, this Privacy Notice does not cover the personal information our customers choose to collect and share with Maxisil where we are not the Controller, but rather the Processor.

Please keep in mind when you link from our Site, the information you provide to the other third-party site or platform is governed by the privacy notices and terms set by those third parties – and not Maxisil.

B. Collection of Personal Information and Purposes of Use

Maxisil collects information relating to or identifying individuals (Personal Information) from several sources. The Personal Information we collect is generally determined by you and your interaction with us, our partners, publications, and other resources acting on our behalf.

Maxisil does not sell your data. We do disclose Personal Information for purposes of cross-contextual behavioral advertising, but we do not knowingly sell our customers’ Personal Information. Period.

               How and where does Maxisil collect information?

Maxisil collects Personal Information from potential customers, customers, participants at our events (in-person or virtual), business partners and vendors and their employees, advisors, contractors and individuals who choose to use our Products and Services (collectively, Individuals) who:

  • Visit and/or shop our Site;
  • Receive or send communications from/to us, including email, phone calls, texts, and mail;
  • Use our Services as a customer or authorized user;
  • Register for, attend and/or otherwise take part in our events, promotions, contests, etc.;
  • Download or otherwise engage our content or publications;

  • Participates as an influencer, where we collect information about social media posts;
  • Engage with our customer service or our employees;
  • Apply to work with us, view or share job postings on LinkedIn; or

We collect personal information from a variety of sources, including but not limited to:

  • The person who is the subject of the Personal Information;
  • Publicly available sources (such as a voting record, your business information, social media);
  • Third-Party Advertisers we have engaged to do advertising or targeted ads for us;
  • Social media personalities acting as our Influencers;
  • Social media posts and interactions on our accounts;
  • Service Providers; and
  • Business partners and/or vendors.

What type of personal information do we collect?

  • Identifying Information: Maxisil collects this information when you place an order or take advantage of other offers online or contact us through the “Live Chat” feature powered by Drift on our site. For example, name, address, zip code, email, telephone and cell number(s), and security question answers.
  • Payment Information: This information is collected when you make a purchase. For example, your credit card number and billing address, which is processed for us by PayPa While PayPal is acting on our behalf, PayPal has its own policies when it comes to what data they collect from you when you use PayPal’s services.   • Information You Post: We collect this information when you post in a public space.
  • Event Information: This information is gathered when you sign-up for events, such as contact information and mailing address.
  • Demographic Information: Maxisil will collect this information when you take part in a contest, promotion, or survey. For example, email and name.
  • Device Information: We collect device information when you visit our Site, such as the type of device you use to access our platforms, device ID, or IP address.
  • Commercial Information: We collect this data when you make a purchase, such as details about the products purchased or considered, as well as other purchasing histories.
  • Internet or other Network Activity Information: We collect this type of data when you visit our Site or interact with our other technologies. This information is either automatically collected or is customer-initiated. For example, your browsing history, search history, and other data about interactions with our Site or ads. i. How We Use Personal Information

Maxisil collects Personal Information for several purposes, including but not only the following:

  • Product and Service fulfillment.
    • Complete, fulfill, manage, and communicate about purchases, etc.;
    • Set up and service your profile (if any) on our Site;
    • Provide customer service and alert you about product or shipping status; and
    • Manage subscriptions, including order tracking, billing, and any messages with you about those orders, deliveries, or subscriptions.
  • Internal operations.
    • Improve the effectiveness of our Site, webstore, vendors, and customer service;

    • Perform other logistics and operation activities as needed.

Sometimes Information is Vital: Where we need to collect and use Personal Information by law, to complete a transaction with you, or fulfill a contract with you, and you fail to provide the Personal Information required, such deficiency is likely to prevent Maxisil from meeting our obligations.

Other People’s Privacy: If you provide us with Personal Information relating to another person, you must inform them of our identity and why their Personal Information is required and how it will be used, and they must have given consent to share their information with us. THEY have to consent to YOUR use of THEIR personal information. Please know you cannot consent for them.

 

ii. Sharing and Disclosure of Personal Information

We may disclose Personal Information to vetted third parties for business purposes. For example, Maxisil uses WooCommerce to provide our Site and manage and present our store content to visitors. WooCommerce then integrates (on our behalf) with Fed-Ex to properly and safely process your shipping requirements and deliver your order quickly and safely. As noted above, we use PayPal to process your credit card and other payments securely on Maxisil’s behalf.

We also utilize third party service providers to expand our marketing efforts across the internet, including email providers like MailChimp and social media platforms such as Facebook. You can opt-out of third-party marketing use of your Personal Information through our Cookie Preferences center, which you may access here. You can learn more about our marketing efforts in our Cookie Notice below.

Reasons for sharing your information may include the following:

  • General Business Purposes: We may share information with consultants and other service providers for customer or technical support, marketing, sales, operations, account management, chat-bot, and legitimate general business purposes;
  • Compliance with the Law: We may disclose information to a third-party where we are legally required to comply with applicable laws, regulations, legal processes or government requests;
  • Protection of our Rights: We may also disclose information when needed to protect or exercise, establish or defend our legal rights;
  • Business Transfers: We may share or transfer information to support negotiations of or for a merger, sale of company assets, financing, or acquisition of all or a portion of our business;

C. International Transfers, Security and Information Retention

Our Site servers are located in Australia, and our third-party service providers and partners have disclosed to us that they operate, for purposes of processing our data, in the United States and Australia. This means when we collect your Personal information, we process in the US and Australia. NOTE: MAXISIL IS A TEXAS CORPORATEION IN THE UNITED STATES BUT HAS ITS HEADQUARTERS IN AUSTRALIA. WE DO NOT HAVE A PRESENCE IN, BUSINESS IN, OR SOLICIT BUSINESS FROM OUTSIDE THE US OR AUSTRALIA. With that said, we act to and employ measures designed to reasonably protect the Personal Information we hold, including working with our hosting and e-commerce service providers to maintain the security of our systems.

We use appropriate technical, organizational and administrative security measures designed to protect the security, confidentiality and integrity of information.

  1. Data Retention

Maxisil will retain Personal Information we collect from you for the length of time necessary to complete our relationship with you, or there is an ongoing legitimate business need to do so and we have a valid reason to use the Personal Information. We determine the length of our retention periods for Personal Information on the basis of the purposes for the information, the amount, nature and sensitivity of the information used, any potential risk from unauthorized use or disclosure of that Personal Information and whether we can achieve the purposes of the use through other means, as well as on the basis of applicable legal requirements (such as applicable statutes of limitation).When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize it or, if this is not possible (for example, because it has been stored in backup archives), we will securely store and isolate it from further processing until deletion is possible.

D. Your Privacy Rights

We do not have a presence in the UK, EU, Switzerland or other country in the European Economic Area. We do not market or solicit inquiry from those regions, or anywhere other than North America and Australia. If, as a resident of the UK, EU, Switzerland or other country in the European Economic Area, you believe we have collected Personal Data from you, you may submit a request to privacy@maxisil.com to (a) object to processing of your Personal Data, (b) ask us to restrict processing of your Personal Data, (c) request portability of your Personal Data, or (d) request us to correct or delete your data.. Again, you can exercise these rights by contacting us through to privacy@maxisil.com or by using the contact details provided under the How to contact us heading below. In any such inquiry, please provide us with the following:

  • your name;
  • type of request;
  • approximate data of collection of the information; and
  • a valid email address to contact you.
  1. Automated Decision-Making.

Maxisil does not use or process any Personal Data or Personal Information which would subject a person to a decision based solely on automated processing, including profiling, which produces legal effects.

  1. Opt-Out.

You have the right to opt-out of marketing communications (emails or texts) we send you at any time. You can exercise this right by clicking on the “unsubscribe” link in the marketing communications we send you, by texting “STOP” to a text, or by using the contact details provided under the How to contact us heading below. Please note opting-out of marketing communications from us does not opt you out of receiving important business communications related to your current relationship with us, such as communications about your subscriptions or event registrations, service announcements or security information.

  1. Withdrawal of Consent.

If we have collected and used your Personal Information with your consent, you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the use conducted in reliance on lawful processing grounds other than consent.

  1. GPC.

We recognize the Global Privacy Control (GPC) signal. The GPC is a browser setting that allows consumers to opt-out of targeted advertisements and/or the sale of personal information through a pre-determined signal.  The GPC allows you to make a single opt-out request that applies to all websites that recognize the signal. Maxisil’s Site recognizes such a signal.

This section of our Privacy Notice supplements the information contained above and applies to those visitors, users, and others who reside in a state in the United States with an active and enforceable data privacy law (consumers or you). Right to Delete or Correct

Within your right to delete, you may also have the right to correct information which we hold that is incorrect, which may include deleting or updating incorrect information we hold. Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion or correction request if retaining the information is necessary for us or our service provider(s) to:

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Comply with a legal obligation.

We will correct, delete or deidentify Personal Information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

Exercising Your Rights to Know or Delete

To exercise your rights to know or delete described above, please submit a request by either:

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your Personal Information. You may only submit a request to know twice within a 12-month period. Your request to know or delete must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. You do not need to create an account with us to submit a request to know or delete; however, we do consider requests made through your password protected account sufficiently verified when the request relates to Personal Information associated with that specific account. Note we may need additional information, which will not be retained after such a request is either fulfilled or denied.

We will only use Personal Information provided in the request to verify the requestor’s identity or authority to make it.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. Maxisil Does Engage in the “Sharing” of Personal Information for Targeted Advertising
